Crittall Windows is strengthening its position on trademark protection following a ruling by the UK Intellectual Property Office (UKIPO) that declared a similar trademark invalid.
The decision follows a legal challenge brought by the Essex-based steel window and door manufacturer against the registration of the Crittall Style Doors trademark. The tribunal concluded that the trademark was likely to cause confusion with Crittall’s established trademark and had been registered in bad faith. The trademark was therefore declared invalid, with Crittall also awarded costs.
The ruling highlights the importance of protecting the Crittall name, which has been associated with British steel windows and doors for more than 175 years. The company maintains that its trademark helps architects, specifiers, homeowners and trade customers distinguish genuine Crittall products from products marketed under similar branding.
Crittall’s trademark was originally registered in 1928 to protect the company’s name and reputation. Today, the company continues to use that protection to safeguard the authenticity and identity of its products.
