A Pennsylvania court has awarded $42 million to glazing specialist Ventana Design-Build Systems, finding that general contractor Tutor Perini committed repeated contractual breaches that caused significant delays and financial losses during the construction of the 51-storey W Hotel Philadelphia, completed in 2021.

Ventana’s subcontract, originally valued at approximately $14 million, covered the design, fabrication and installation of the building’s aluminium curtain wall and window wall systems. The court found that the company encountered persistent disruptions caused by poor trade coordination, defective concrete work, incorrect rebar placement and debris left by other subcontractors, all of which hindered glazing installation and reduced productivity.

According to the ruling, Tutor Perini knowingly concealed concrete defects, improperly attributed project delays to Ventana and withheld legitimate invoices and approved change orders without justification. The judge concluded that these actions constituted bad-faith conduct and directly increased the glazing contractor’s costs.

The court also ruled that Tutor Perini could not enforce the subcontract’s “no damages for delay” clause because its own actions actively interfered with Ventana’s work. The decision follows a separate $174 million judgment issued earlier this year in favour of developer Chestlen Development, involving widespread construction defects and contractual breaches on the same Philadelphia project.
